1. Acceptance of Terms

By downloading, installing, or using the Pavel’s Dog application ("App"), operated by Pavel Koryagin pr Beograd, a sole proprietorship registered in Serbia at the address: Bulevar Mihajla Pupina 10a, sprat 4, stan 12, 11252 Beograd (Novi Beograd), Serbia, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the App.

2. Description of the App

Pavel’s Dog is a language learning application that uses AI-powered features to help users practice and improve their language skills.

3. License Grant

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App, subject to these Terms.

4. Use Restrictions

You may not misuse the App. This includes reverse engineering, scraping, circumventing security measures, sublicensing, or using the App for any unlawful or harmful purpose.

5. Eligibility

You must be at least 13 years of age to use the App. Children under the age of 13 cannot use or register for the App.

If you are 13 years of age or older but have not yet reached the age of legal majority in your jurisdiction (in many places, this is 18 years old), you must have your parent or legal guardian read and agree to these Terms on your behalf before you use the App. If you are a parent or guardian providing consent for your child's use of the App, you agree to be bound by these Terms with respect to your child's use of the App, and you are responsible for your child's activity on the App.

By using the App, you represent and warrant that you meet these eligibility requirements.

6. User Accounts

6.1 Account Creation: To access certain features of the App, you must create an account.

6.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

6.3 Account Termination: We reserve the right to terminate or suspend your account if you violate these Terms or engage in any activity that disrupts or interferes with the App.

7. User Content

Users can add content for their own use but cannot post content within the App for others. Any content added is for personal use only and is not moderated by us.

8. Intellectual Property

We own all rights to the App, including its design, features, and content we provide. You retain ownership of any content you create. By using the App, you grant us a license to use your content as necessary to operate the service.

Any feedback or suggestions you provide may be used by us without compensation or attribution.

9. Privacy

Your use of the App is subject to our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the practices described in the Privacy Policy.

10. Third-Party Services

The App relies on third-party services to provide its functionality, including AI providers, payment processors, and infrastructure services. These third-party services are governed by their own terms of service and privacy policies. We are not responsible for the availability, performance, or conduct of any third-party services. 11. EU Consumer Rights

If you are in the European Union, you have a 14-day right to withdraw from digital purchases. By using the App immediately after purchase, you consent to waive this withdrawal right.

12. Disclaimer of Warranties

YOUR USE OF THE APP IS AT YOUR SOLE RISK. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

THE APP USES AI TO GENERATE PERSONALIZED CONTENT AND EXPLANATIONS. AI-GENERATED CONTENT MAY CONTAIN ERRORS OR INACCURACIES. ALWAYS VERIFY IMPORTANT INFORMATION INDEPENDENTLY.

13. Limitation of Liability

Our liability is limited to the maximum extent permitted by law. We are not liable for any indirect, incidental, or consequential damages arising from the use of the App.

In no event shall our total liability exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your violation of these Terms, your use of the App, or your violation of any third-party rights.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Belgrade, Serbia. You agree to submit to the personal jurisdiction of such courts.

16. Dispute Resolution

Any disputes will be resolved through the most cost-effective and efficient means available, such as mediation or arbitration.

17. Statute of Limitations

Any claim arising from these Terms must be brought within one (1) year of the cause of action.

18. Changes to Terms

We may update these Terms from time to time. Registered users will be notified via email, and updates will be published at pavelsdog.com/legal.
